  Welcome to RadianceTravel.com (the “Site). This Site is offered to you conditioned upon your acceptance and acknowledgement of all the terms, conditions, notices and obligations described below (collectively, the “Agreement”). If you continue to browse and use this Site you are agreeing to comply with and be bound by the following terms and conditions, which together with our privacy policy govern Radiance Travel’s relationship with you in relation to this Site.

The term “we”, “us”, “our” and “Radiance Travel” refer to Radiance Travel, a California corporation, and/or our subsidiaries, affiliates or legal partners. The term “you” and “yours” refers to the user or customer who visiting the Site and/or booking a reservation through us on this Site, or through our customer service travel specialists.

Please read the terms and conditions carefully. If you do not accept all of these terms and conditions, please do not use this Site. We reserve the right to change these terms and conditions at any time without prior notice. Your continued use of this Site signifies your acceptance of the updated or modified terms and conditions. Please return to this page periodically to review any changes or updates.
 
     
  Ownership  
  The contents, materials and information on this Site (including but not limited to the price and availability of travel services), and the infrastructure used to provide such contents, materials and information, is owned by us and/or our affiliates, suppliers, providers or distributors. Much of the content and data found on this Site is proprietary to our suppliers and providers. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. You may not create a link to this Site from another website or document without Radiance Travel’s prior written consent.  
     
  Site Usage Top
  By using this Site, you warranted that you are at legal age and possess the legal authority to create a binding legal obligation and you will use this Site in accordance with this Agreement. You agree to be financially responsible for all of your use of this Site. Further, you will only use this Site to make legitimate reservations for you or for another person for whom you are legally authorized to act. It is your responsibility to inform such other person the terms and conditions of this Agreement prior to making a reservation on their behalf. You also warranted that all information provided by you or on your behalf on this Site is true, accurate, current and complete. Without limitation, any exploratory, false or fraudulent reservation or any reservation in anticipation of demand is not allowed. We reserve our right to deny access to anyone to this Site and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement. Further, we retain the right to cancel any and all bookings or other transactions you have made on the Site after you have been prohibited from using the Site, with no liability whatsoever to you.

This Site and the content provided in this Site, including the text, graphics, button icons, digital downloads, data compilations, logos, services marks and software, may not be changed, distributed, licensed, transmitted, displayed, reproduced, published, posted, reverse engineer, transferred, sold or re-sold without written permission by us, and/or our affiliates, suppliers, providers or distributors; except that you may print and download travel materials on this Site for your personal, non-commercial use only.

All airfares, prices and fees displayed by us are in U.S. Dollars. Radiance Travel assumes no responsibility, and shall not be liable for any losses, damages, costs, claims, expenses, or fees incurred due to currency fluctuations.
 
     
  Limitation of Liability Top
  Information contained in the Site (including text, graphics, links or other material) is provided on an "as is," and "where available" basis. Radiance Travel makes no representation or warranty, express or implied, to you or another person or entity as to the accuracy, results, timeliness, completeness, merchantability, fitness for any particular purpose with respect to the Site or any related materials, products, services, or information. The information, products and services published on this Site may include inaccuracies or errors, including pricing errors. Radiance Travel does not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the air, hotel, cruise, car and other travel products and services presented on this Site (including, but not limited to, pricing, photographs, list of hotel amenities, general product descriptions and so forth), much of which information is provided by suppliers, providers or distributors. Price and availability information, as well as other information contained in this Site, is subject to change without notice. Further, Radiance Travel retains the right to correct any pricing errors on our Site and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation.

Radiance Travel, and its affiliates, directors, officers, employees, agents, contractors, successors or assigns assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this Site or your downloading of any materials, text, data, images, video or audio from the Site. In no event shall Radiance Travel or any third party suppliers, providers or distributors be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of this Site or content found herein, (ii) any failure or delay (including, but not limited to use of or inability to use any component of this Site for reservations or ticketing), or (iii) the performance or non performance by Radiance Travel or any third party suppliers, providers, and distributors (including, but not limited to, non performance resulting from reorganization, bankruptcy, insolvency, dissolution or liquidation even if such party has been advised of the possibility of damages to such parties or any other party. In no event shall our aggregate liability, or that of our suppliers, providers or distributors, exceed the total charges set forth in the itinerary when giving rise to any such liability. Any claim or cause of action arising from, or relating to, your access and use of, or purchase of products and/or services from, the Site must be brought within one (1) year from the date on which such claim or action arose or accrued or purchase was completed. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
 
     
  Hotel Descriptions and Ratings: The hotel description in this Site are considered to be correct and accurate at the time of writing and therefore Radiance Travel cannot be held responsible for any changes in the hotels services, furnishings or equipment which the guests may find on arrival at the accommodation. In addition, hotel ratings shown on this Site are intended as general guidelines, and we do not guarantee the accuracy of the ratings. Radiance Travel and our respective suppliers make no guarantees about the availability of specific products and services.  
     
  Consumer Disclosure Notice: Radiance Travel is acting as intermediary and as an agent for suppliers (including, but not limited to airlines, hotels, cruises, car rental agencies, railroad, tour operators, consolidators, vacation packages, activities suppliers, ground transportation providers, meals, and travel insurance providers) in selling travel services or in accepting reservations or booking for travel services that are not directly supplied by us. We, therefore, shall not be held responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which results in any loss, damage, delay, accident, expense or inconvenience caused by the late arrivals or departure, change of schedule, strikes or any other conditions, nor will we be held responsible for any loss or damage to baggage or any of the customers belongings, or injury on you or your travel companions or group members. Radiance Travel shall not be liable for any variation in price or change in schedule or equipment or accommodations for any travel services, which occurs subsequent to payment for such service.

In the event that a supplier defaults prior to providing the service to you for which payment has been made, the sole recourse for refund shall be with the defaulting supplier, from insurance covering such defaults if any or from other responsible third party. Radiance Travel shall use its best endeavors to provide the highest standards of services in the trade and will use appropriate care in selecting suppliers so as to protect you from such default.

Radiance Travel assumes no responsibility for actions relating to travel services beyond the control of our employees or us (including, but not limited to any injuries, damages or losses to you or any traveler in connection with outbreak of hostilities between nations, terrorist activities, social or labor unrest, mechanical or constructions difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other activities, omissions).

You assume complete and full responsibility for, and hereby release Radiance Travel from, any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. Further, you assume all risks involved in such travel, whether expected or unexpected. Radiance Travel is not responsible for cancellation of any services and/or refunds from any supplier or carrier that may cease operations. You are hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and is advised to obtain appropriate insurance coverage against them. The retention of your tickets, reservations, or bookings after issuance shall constitute a consent to the above and an agreement on your part to convey the contents hereto to you, and your travel companions or group members. You are responsibility to reconfirm your itinerary at least 72 hours prior to your departure date with your assigned air carrier, land transportation, cruise, and tour or resort vacation. Radiance Travel is not responsible for any flight or time changes made by the assigned supplier.
 
     
  Privacy Policy Top

  Indemnification Top
  You agree to indemnify and protect Radiance Travel, and/or its suppliers and any of its officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of this Agreement or the documents referenced herein, violation of any law or the rights of a third party, or use of this Site.  
     
  Suppliers and Providers Rules and Restrictions Top
  You agree to withstand by the terms and conditions of purchase imposed by any supplier, provider, and distributor (including, but not limited to airline, hotel, car rental company, cruise, tour operator and other travel vendors that provide travel related products and services) with whom you elect to purchase their products and services, including, but not limited to, payment of all amounts when due and compliance with their rules and restrictions in relating to availability and use of fares, products, and/or services.  
     
  Airlines Ticket and Purchase Top
  All air reservation requests submitted to Radiance Travel are on requests only, even if availability displays are given. After we have received your air reservation request, you will receive a confirmation email to confirm the request information. After receiving the request, your booking will be quality-checked by our travel specialists and processed within two business days.

To protect our customers, our travel specialists checked and verify the following details before issuing your tickets:

1. Accuracy of booking information provided, for instance, check for spelling errors
2. Accuracy of the fares for your selected flights and check for any price changes that may have surfaced during processing
3. Verify airline’s minimum connection times and correct selection of airports
4. Verify if the airline requires paper tickets for your selected itinerary
5. Making sure the billing address and credit card information given by you corresponds to those on record with the credit card issuer
6. Obtain credit card approval to issue ticket

If our travel specialists encounter any question or problem during this verification process, we will contact you by either phone or email. Otherwise, we will issue the tickets and send a confirmation email to you within 48 hours of your reservation request. The confirmation email will include all travel itinerary details and ticket number(s).

An email notification will be sent to those reservation requests that cannot be confirmed and/or verified. While processing your transaction if your credit card declines, we will make every effort to contact you by an email message within 2 business days. The transaction will not be processed if your credit card has declined or any information provided cannot be verified. The fare and other booking information are not guaranteed.

We are not responsible for any transaction that is declined due to a credit card that is declined by the issuing company or a travel provider or if, for any reason, the debit/credit card billing address and/or credit card verification number cannot be verified in a timely manner, nor are we responsible for any change in fare or any other changes that may occur during the verification process. At time when the selected fare is not available an approval code may have been obtained on your credit card, if transaction is not completed the approval code may block your available credit for a time period until the bank removes the block.

When an electronic ticket cannot be issued, a paper ticket will be issued and shipped. Certain airlines and we will charge you for the paper ticket issuing and processing fees. We assumes no responsibility and shall not be liable for any losses, damages, costs, claims, expenses, or fees relating to the shipment of paper tickets and you accept all risk of loss pertaining to the same. If your paper tickets are undeliverable and are returned to us, there will be an additional $50.00 re-handling fee.

All our offers, prices, and conditions of sale may be subject to (a) change without notice; (b) advance purchase, eligibility, seating, availability, lower prices may be available; (c) reservation validation limitations of up to one year (if any extension permitted, penalties/restrictions may apply; and/or other limitations, conditions/restrictions; (d) if your itinerary involves an ultimate destination or stop in a country other than the country of departure, the provisions of a treaty known as the "Warsaw Convention" may be applicable to your entire trip, including any portion entirely within the country of origin or destination. The Warsaw Convention governs and may limit the liability of certain air carriers for death of or personal injury to passengers and/or loss of or damage to baggage.
 
     
  Changes, Voids and Cancellations Top
  Changes or cancellations made to the itinerary is subjected to airlines fare rules and restrictions. All our tickets/hotels/car/packages/cruises do not permit any date or name changes after the booking is completed. Radiance Travel does not guarantee and shall not be responsible for any bookings or reservations made to you in the event that the original itinerary has been changed as per customer’s request.

For any itinerary where changes may be allowed, Radiance Travel charges $50.00 per ticket, plus those fees (Airlines penalties and any fare difference) assessed by the airlines, for exchanges. Please contact our travel specialists to find out the total cost of exchanging your ticket.

All airline tickets are fully non-refundable. In some cases where airlines may allow cancellations, a credit may be available for future ticket purchase with applicable penalty and a fare difference if any, with travel valid on the same airline. Very often the credit is valid only for a particular timeframe and you should discuss it with our travel specialists for detail. If you do not use the credit within its validity, you will lose the credit amount. All such bookings where cancellations may be allowed must be cancelled prior to the schedule departure time of the first flight segment by contacting our travel specialists or respective airlines directly.

The cancellation fee for Radiance Travel is $50.00 per ticket and must be paid to us at the time of cancelling the booking. When you are ready to make the new booking with your credit, you will have to pay fare difference (if any), applicable airlines penalities for that fare and our exchange fees. All such changes are governed by the airline fare rules; we do not provide any representations or guarantees on changes or fees.

In the event where airlines may permit refunds, you will be responsible to pay our refund fees $50.00 per ticket in addition to airlines penalty, if any. Refunds from our third party supplier, provider or distributor will be made available to you only after we have received the payment. Fees, if applicable, charged by us for the initial reservation will not be refunded.
 
     
  Name on Reservation Top
  It is vital that all reservations must be made in the exact name of the person traveling, as stated in the government issued IDs or passport of the traveler. Once tickets are issued, no name change can be made. Should names need to be corrected, additional fees may be assessed and in certain cases, it may result in purchasing new tickets.  
     
  Special Requests Top
  In regards to special requests (including, but not limited to window/aisle seats, special food request, room view, bedding type, special car type for rental cars, etc), you are required to contact our third party suppliers, providers or distributors directly after purchase confirmation. Please note these special requests and arrangements are subject to availability. In most cases, seat assignments may be arranged during the reservation process; however, the airline reserves the right to apply any revisions to the requested seat allocation without notification. You expressly accept the possibility that our third party suppliers, providers or distributors may not satisfy your special requests or may charge you extra fees when making a special request through us. No purchase or reservation may be canceled because of the failure of our third party suppliers, providers or distributors to fulfill any special requests.  
     
  Air Ticket General Rules and Restrictions Top
  All flights should be reconfirmed with the airlines directly as they may have last minutes schedule changes. We suggest that you do so at least 24 hours prior to departure for domestic flight and 72 hours for international destinations.

Tickets may be purchased for minors age 18 and under, and an adult must accompany them when traveling.

Many of our discounted tickets do not allow frequent flyer mileages accrual.

In most circumstances, standbys and upgrades will not be allowed.

All travelers are recommended to verify travel documents such as passport validity, transit visa and entry visa for the country that they are transiting through and entering. Updated and reliable information about international travel can be found at www.travel.state.gov and with the consulate of the country you are traveling or transiting through. By selling tickets to you, Radiance Travel does not imply any guarantee of passenger’s ability to enter the country of destination. Traveler understands that we accept no responsibility for determining passenger’s eligibility to enter or transit through any particular country.

Travelling to certain destinations may involve greater risks than others. Radiance Travel urges travelers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. By offering for sale travel to particular international destinations, Radiance Travel does not warrant that travel to these destinations is advisable or without risk, and is not liable for damages or losses that may result from travel to these destinations.

The duty or departure tax for a passenger may be assessed upon departure from some international destinations such as Australia, Mexico, and the United Kingdom. This is the responsibility of the passengers and is not collected by us upon purchase.

Most airlines add surcharges such as oil surcharges to the ticket prices. Depending on the airlines, the surcharge is either included in the base fare that we display or added as taxes and/or fees and therefore displayed separately.

The amount list as “taxes” on the Site may sometimes includes “tax recovery charges”. It means the airlines, not Radiance Travel, have the obligation to collect any applicable taxes, governmental fees and other charges and remit them to the government. In other words, what we are collecting from you is a “tax recovery charge” equal to the amount we expect the airlines to collect from us, in satisfaction of those taxes, government fees and other charges they must remit to the government.

Many airlines are charging customers bag-checking fees, which include, but not limited to initial bag checking fees, additional bag checking fees and excess baggage weight fees. The rules, regulations and amounts charged vary by airlines. These baggage fees cannot be pre-paid at our Site nor factored into the base fare. They must be paid at check-in with the respective airlines. It is recommend checking the baggage weight restrictions with the airlines prior to your departure.

Please note the charges listed in this “ Taxes and Fees” section are not exhaustive and the final price charged to you may include other charges, costs and fees.

Radiance Travel makes no representation or warranty of any kind regarding this “Taxes and Fees” section, and all information is provided to you “as-is”. Further, we assume no responsibility and make no representation or warranty of any kind regarding your use of our travel specialists, and shall not be liable for any damages, costs, losses, or expenses that arise out of the same.

 
  Human Error or Travel Agent’s Error Top
  If there is any human error or our travel agents makes a mistake in the booking process, we shall make reasonable attempts to rectify these errors at the time of occurrence. You must notify us of any errors or mistakes within 24 hours of receiving your itinerary. Beyond this 24-hour period, we will not be responsible for these errors or mistakes.  
     
  Payments Terms Top
  Traveler, the purchaser of the ticket(s) as stated on the invoice, is solely responsible for the full payment of the invoice. Unless there are prior arrangements with our accounting office, full payment by cash or check is due upon delivery of the invoiced ticket(s). Payment by credit card will only be accepted if the name on the credit card used matches the name on the reservation. In case the credit card holder and the traveler are different persons, the credit card holder can make payment for the traveler only if he/she signs a credit card authorization form provided by Radiance Travel stating that he/she is responsible for the full payment on the said traveler. In case of refuse, reject or decline on credit card payment, the credit card holder and/or traveler will ultimately be responsible for full payment of the invoice and any cost incurred in collection of such amount. Additional credit card payment terms are listed below:

1. All credit cards must have a valid United States or Canadian billing address.
2. If you are making an online booking for another individual or company or you are using foreign credit cards, please contact us at info@radiancetravel.com with your requirements.
3. You agree to be liable for any and all credit card payments disputes or other problems such as fraud made to us or the supplier on behalf of you or any individual you are representing. You agree to reimburse Radiance Travel in cases of fraud or charge backs.
4. We use stringent safety measures for credit card payment processing. Fraudulent transactions if any, are reported to airport security, airlines and other federal and state organizations.
5. Online credit card transactions are authorized at the time a user or anyone acting on their behalf accepts these terms and conditions and provides an electronic signature
 
     
  Credit Card Authorization Forms Top
  In the event Radiance Travel, in its sole discretion, deems your reservation request a high risk booking such as foreign origination ticket, one-way international ticket, we require the credit card holder to fill out the credit card authorization form. We will email the credit card authorization form to the credit card holder once the reservation is complete. Please note we do not guarantee the fares may be valid until we receive the credit card authorization form filled out. All issued tickets are non-refundable.  
     
  Minors under 18 years of age traveling to Mexico must travel with the consent of both parents. Top
  If a minor is traveling to Mexico with only one parent, the parent must present a notarized letter of consent from the absent parent or a copy of the legal document giving that parent sole custody. If the absent parent is deceased, a copy of the death certificate is necessary. If a minor is traveling to Mexico without legal parents, a notarized letter of consent must be submitted and signed by the legal parents. It is the traveler’s responsibility to provide proper documentation. No refunds will be made if improper.  
     
  Hotel Reservations Top
  Prepaid Hotel Reservations: Prepaid hotel reservations are prepaid. The room rate displayed on the Site is a combination of the pre-negotiated room rate for rooms reserved on your behalf by Radiance Travel, and our third-party suppliers, plus a service fee to compensate us for our services. You authorize Radiance Travel and/or our third-party suppliers to book reservations for the total reservation price that includes the room rate shown on the Site, plus tax recovery charges, and service fees, where applicable, and taxes, where applicable. You consent that your credit card will be charged by Radiance Travel and/or our third-party suppliers for the total reservation price. Upon submitting your reservation request you permit us to facilitate hotel reservation on your behalf, including making payment arrangements with our hotel suppliers. You acknowledge that individual hotels may collect other payments locally for minor items such as meals, movies, games, wet bar, phone calls and parking that consumed by you during your stay.

Some hotels will require a voucher at check-in. At time we will provide you with the voucher to your email address. Please bring a copy of your email confirmation with you for check-in.

You may cancel or change your prepaid hotel reservation, but you will be charged the cancellation or change fee shown in the rules and restrictions for the hotel reservation. If you do not cancel or change your reservation before the cancellation policy period applicable to the hotel you booked, which varies by hotel prior to your date of arrival, you will be subject to a charge of applicable nightly rates, tax recovery charges and service fees. In the event you do not show for the first night of the reservation and plan to check-in for following nights in your reservation, you must confirm the reservation changes with the hotel no later than the date of the first night of the reservation to prevent cancellation of your reservation. No reservation can be cancelled after the date of check-in, and you are responsible for any and all "no show" charges.

You agree to pay any cancellation or change fees that you incur. Please note some hotels do not allow changes or cancellations of reservation after they are made, as stated in the rules and restriction for the hotel reservation. You agree to abide by the terms and condition set forth to your prepaid hotel reservations. Any modification to date, number of rooms reserved, room type, traveler’s names, etc is at the sole discretion of the individual hotel policy. We charges $15.00 fee for any change or cancellation per reservation.

Non-Prepaid Hotel Reservations: Non-prepaid hotel reservations use your credit card to hold your hotel reservation until you arrive check-in. It is recommended that you confirm non-prepaid reservations directly with the hotel. These policies may vary depending on locations and dates of travel/season.

Cancellations can only be made in a particular timeframe that are stated on your confirmation. Additional hotel refund policies may applicable. Refunds are at the sole discretion of the individual hotel and may not result in full refund. Cancellation and/or change fees may vary based on hotel property restriction or dates of travel. Some non-prepaid hotel may require a deposit up to and including full amount of the stay, which may result in non-refundable cancellations and no modifications permitted. Any modification to date, number of rooms reserved, room type, traveler’s names, etc is at the sole discretion of the individual hotel policy. We charges $15.00 fee for any change or cancellation per reservation.

Please note no reservation can be cancelled after the date of check-in, and you are responsible for any and all "no show" charges. You agree to pay any cancellation or change fees that you incur. We recommend you to verify the cancellation policy prior completing your purchase.
 
     
  General information about hotel reservations:

1.  Currency conversions are based on approximate exchange rates at the time of booking and should be used for an approximate guide only.
2. In order to honor certain discount and/or special rates such as corporate, government (including military), AAA or AARP membership, you are required to present identification at the time of check-in to prove that you qualify. Hotel properties are not obligated to honor these rates if you do not qualify.
3. Most hotels will make every effort to honor your hotel requests for particular features such as non-smoking rooms or bedding type; however, neither Radiance Travel nor the hotel can guarantee that your request will be honor.
 
     
  Vacation Package and Tours Rules and Regulations Top
  Radiance Travel reserves the right to amend our Vacation Package and Tours Terms and Conditions at any time without notice. In the event that our Vacation Package and Tours Terms and Conditions change, the modified terms will go into effect on the date when posted on this Site. Please note the modified terms and conditions, including but not limited to, change and cancellation policies as shown below shall take precedence over any previously published and conflicting applicable policies and terms and conditions to any individual travel product included in the Vacation Package and Tours.

All prices are displayed in United States Dollars (USD). Radiance Travel retains the right to correct errors in any advertised price prior to your departure.

Reservation will be cancelled if the full payment is not received within 7 days after confirmation of the reservation. Further, no portion of the Vacation Package and Tour is guaranteed such as price, availability and dates of travel, etc until full payment of the whole Vacation Package and Tour is received. Please note payment in full constitutes final acceptance of our Vacation Package and Tours terms and conditions.

All tickets and travel documents will be issued as per your passport name. Airlines do not allow travelers to change name on tickets after purchase. Misspell or incorrect names will constitute a cancellation. Rebooking will be subject to availability and airlines and hotels imposed cancellation penalties.

A government issued photo ID is required at all time throughout the trip for security checks at airports, hotels, car rental locations, attractions and other travel related products so deemed by suppliers. Furthermore, proof of citizenship is required for all international travel, for all countries outside of the United State of America. Citizens of the United States must carry a valid passport for international travel. Please note it is your sole responsibility to provide proper travel documents. You may contact the corresponding local consulate of the countries to which you are traveling for any questions. You will not be entitled for any refunds if travel with improper travel documents and resulting in denied boarding, delayed travel, or unused portions of your vacation package and tour.

Each section of your Vacation Package and Tour is supplied by an individual airline, hotel, rental car company and other travel service suppliers (collectively, a “Travel Provider). If a Travel Provider is cancelling a portion of your Vacation Package and Tour, we will, per your request, try to get alternative arrangements; however, we will not be responsible for the performance of the Travel Provider, and/or for the reimbursement of money paid by you, and/or any incidental or other damages if the Travel Provider fails to carry out its obligations.

Frequent traveler mileages and/or points may or may not be accrued for any potion of a Vacation Package and Tour.

Prices, taxes/fees and Payment: Our Vacation Package and Tour prices may include fees and taxes related to airfare, hotel accommodation, transportation, and local activities. Additional surcharges or fees (such as fuel, security, baggage, etc) may apply and will be charged by the individual Travel Provider. You are solely responsible for any such additional fees due to Travel Provider. Government entry and exit fees may apply, depending on your destination.

Prices quoted in the Vacation Package and Tour do not include Insurance premiums, any expenses due to delay or changes of schedule, overbooking of accommodations, Federal Inspection fees for the Federal U.S. Customs and Immigration; International Air Transportation tax; agricultural tax; any other charges levied by local state, federal or national government agencies; security fees; airport taxes and fees; port taxes; passports; visas and vaccinations; tips to your Tour Director, driver, Local Guides, and ships' crew; gratuities on ferries, trains, and cruise ships; laundry; telephone; mini bar; alcohol, beverages(these extra items will be billed to you before leaving the hotel, ship, or restaurant); optional excursions; porterage at airports; travel protection; excess baggage fees; and all other items of a personal nature not outlined in the Vacation Package and Tour itinerary.

When the payment is made by a valid credit card, you, herewith, authorize Radiance Travel and its authorized third party to process the charge the credit card you provide to us for the total amount of Vacation Package and Tour. Please note you will be required by Travel Providers to present a valid credit card at the time of check-in at the hotel and/or at the pick-up location of the car rental company to provide confirmation of authorized card usage and/or to secure any additional charges. The cardholder must be a traveler listed on the booking.

Vacation Package and Tour Changes and Cancellations: You must contact Radiance Travel prior to departure to change or cancel any Vacation Package and Tour bookings.

Once a package or tour is booked, some or all of the components may be non-refundable. It is recommended reviewing Travel Providers’ changes and cancellation policies before making a purchase.

Please note any change or cancellation to one travel product component of the package or tour cannot be done without the appropriate change of the others travel product components.

Any change fees must be paid in full at the time of change with the original form of payment.

In most cases, no changes are permitted and no refunds will be made within seventy-two (72) hours of departure.

You shall be responsible for any and all cancellation fees assessed by Travel Providers, applicable for airline tickets, hotel reservations, car rental/other land transportation bookings, and other travel services.

If you need to make changes after departure, the cost of any changes or additions will be at the local rate at the time of the amendment, not per Radiance Travel website or brochure, and must be done by the traveler. No refunds will be made for early check-out and/or car rental return, and/or for any unused portion of the Vacation Package and Tour.

Changes and cancellation are subject to a $75.00 penalties charged by Radiance Travel per package/tour plus applicable air, hotel, car, and any other travel product component associated penalties outlined at the time of the booking.

Any change to your Vacation Package and Tour are subjected to the fees listed below:

i) $75.00 change fee per package/tour.

ii) Any other change fee assessed by Travel Providers (note that change fees may vary by Travel Providers and may be higher during peak season).

iii) Any increase in price resulting from a change.

When a portion of your Vacation Package and Tour is refundable, the refundable portion will be refunded less any cancellation fee. The date of cancellation of your Vacation Package and Tour determines the cancellation fee as shown below:

i) $75 cancellation fee per package/tour for cancellations made more than seventy-two (72) hours prior to departure plus applicable Travel Providers cancellation fees (cancellation fees may vary by Travel Supplier).

ii) 100% of package/tour price will be forfeited for cancellation made within seventy-two (72) hours prior to departure.

No refund will be applied for any unused or partially used portions of your Vacation Package and Tour.

Responsibility: Radiance Travel makes arrangement with third-party vendors for tour and package services and accommodations, including air and land transportation, accommodation, car rental and other tour operator who providing travel related services (collectively, a “Travel Provider”). We are not an agent of the customer or Travel Provider who supplying travel related services. By using this Site, the customer waives any claim against Radiance Travel, its subsidiaries or affiliates, and any of such party's officers, directors, agents, contractors, or employees, and expressly agrees that neither Radiance Travel nor any of its subsidiaries, affiliates, officers, directors, agents, contractors or employees, shall be held liable for (i) any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any third party such as an airline, train, motor coach, private car, cruise vessel, boat, or any other conveyance, hotel, which is to or does supply any goods or services for this vacation package and tour; (ii) any changes, delayed departure, missed connections, substitutions of accommodations, terminations of service, changes in fares and rates, over booking of accommodations, default of any third parties, sickness, weather, strike, natural disasters, acts of government’s civil disturbances, war, quarantine, customs regulations, epidemics, criminal activity or for any other cause beyond its control; (iii) value, reliability, quality or authenticity of any goods purchased while on tour or for any mailing, freight or shipping arrangements; (iv) any cancellation or double booking of reservations or tickets beyond the reasonable control of Radiance Travel; and (v) any claim of any nature arising out of or in connection with air or other transportation, services, or other features performed or occurring in connection with any package component.

Radiance Travel strongly recommends the purchase of travel insurance, which may help to recover certain change and cancellation fees. We reserves the right to decline to accept, or retain any person as tour participant, should such person’s health, mental condition, physical infirmity or general deportment impede the operation of the tour or the rights, welfare or enjoyment of other tour participant.

Upon termination of this Agreement and these terms and conditions, all rights granted to you will terminate and revert to Radiance Travel and its third party suppliers, providers, or distributors, as applicable.

  These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

  Governing Law Top
  This Agreement will in all respects be governed by and construed and interpreted in accordance with the laws of the State of California, without regard to its conflict of law principles.

  Radiance Travel may at any time modify these terms and conditions and your continued use of this Site will be conditioned upon the terms and conditions in force at time of your use.  
     
  Waiver Top
  No waiver of a breach of any provision of this Agreement shall have any force or effect unless in writing, signed by a duly authorized representative of the party to be charged.  
     
  Dispute Resolution Top
  Any dispute, claim or controversy arising out of or in connection with or relating to the subject matter of this Agreement, or any breach thereof, including, but not limited to, all issues regarding jurisdiction, existence, scope, validity, performance, interpretation, and termination, shall be settled through binding arbitration before a single arbitrator administered by the American Arbitration Association in accordance with its then current Commercial Arbitration Rules. If you are not a U.S. resident, the International Arbitration Rules of the American Arbitration Association shall be used. The arbitrator shall have jurisdiction to award, and shall award, the prevailing party its reasonable attorneys’ fees, costs and expenses. All arbitration proceedings shall be held in Ventura, California, U.S.A. Should any provision, section or part of this Agreement be deemed illegal, invalid or unenforceable by a court of competent jurisdiction, that element of the Agreement may be severed and will not affect the validity or enforceability of the remaining portions of this Agreement in that jurisdiction. Judgment on any arbitration award may be entered in any court having jurisdiction over the subject matter or the parties. Notwithstanding the foregoing, this provision shall not preclude either party from seeking temporary, provisional, or injunctive relief from any court.

To the extent you have in any manner violated or threatened to violate the Site's intellectual property rights, Radiance Travel may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you agree to exclusive jurisdiction and venue in such court
 
     
  Attorney’s Fees Top
  All costs and expenses incurred by the prevailing party in enforcing or defending this Agreement or an arbitration award (including, without limitation, reasonable attorneys’ fees) shall be paid by the non‑prevailing party in that particular action or proceeding.
